Montgomery County Raises Right-of-Way Permit Bond Amounts

Effective February 2026, Montgomery County has increased bond amounts for public right-of-way permits, setting them at 150% of total construction costs based on updated unit prices — a change from the prior 100% rate, which had not been updated in over 30 years. The adjustment applies to the approximately one-third of the 3,000-plus right-of-way permits issued annually by DPS that require a bond. Applications received before February 2, 2026 are subject to the previous bond requirement; permit fees remain unchanged.
